Terms and conditions

1. Acceptance

These Terms and Conditions govern your access to and use of SpotActor, including our website, profiles, search, contact reveal, messaging-adjacent features, and related services. By accessing SpotActor, creating an account, signing in, publishing a profile, or using any part of the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use SpotActor.

2. What SpotActor does

SpotActor is a portfolio discovery platform for performers, actors, talent, casting professionals, production teams, agencies, and similar industry users. Talent users can create public portfolio profiles. Creator users can publish organization profiles, browse public talent profiles, and reveal talent contact details subject to platform limits and eligibility rules.

SpotActor is not an employer, casting agency, talent agency, background verification service, payroll provider, payment intermediary, or guarantor of any opportunity, audition, role, contract, fee, payment, safety arrangement, visa, travel, or production outcome.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into these Terms to use SpotActor. You are responsible for the accuracy of the information you provide, for keeping your email account secure, and for all activity under your SpotActor account. You may not impersonate another person or organization, create misleading profiles, or use another user's account without permission.

4. Profiles and user content

You retain ownership of the profile information, photos, reels, credits, training, awards, links, contact details, logos, and other materials you submit to SpotActor. You grant SpotActor a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, transmit, and use that content as needed to operate, improve, secure, and promote the service.

You represent that you have the rights and permissions needed to upload and publish your content, and that your content is accurate, lawful, non-infringing, and not misleading. We may remove content or suspend access if we believe it violates these Terms, law, platform safety, or another person's rights.

5. Contact sharing and offline dealings

SpotActor is designed to let casting and production professionals discover talent and, when permitted by the platform, reveal talent contact details. When a creator reveals a talent's contact information, the talent may see a record of that reveal and basic creator profile details. Creator business contact details may also be visible to talent in connection with reveal activity.

After contact details are shared, any communication, audition, meeting, negotiation, offer, contract, engagement, payment, travel, safety arrangement, dispute, misconduct, or other interaction between users happens independently between those users. SpotActor is not responsible for, and does not control or endorse, what happens between casting agents, creators, production teams, actors, talent, or any third parties after they connect through the platform.

You are responsible for your own due diligence, professional judgment, safety precautions, contracts, payments, taxes, permits, and compliance with applicable laws. Do not misuse contact information, scrape profiles, send spam, harass users, or contact anyone for unlawful, abusive, misleading, adult, exploitative, or unrelated purposes.

6. Acceptable use

You agree not to use SpotActor to violate law, infringe rights, upload harmful code, disrupt the service, reverse engineer private systems, bypass reveal limits, harvest data, resell access, send unsolicited bulk messages, discriminate unlawfully, threaten or harass others, or submit content that is fraudulent, defamatory, obscene, exploitative, or unsafe.

7. Availability and changes

We may update, suspend, limit, or discontinue any part of SpotActor at any time. We may change these Terms from time to time. Updated Terms will be posted on this page with a new last updated date. Your continued use of SpotActor after changes take effect means you accept the updated Terms.

8. Suspension and termination

We may suspend or terminate accounts, hide profiles, limit contact reveals, or remove content if we believe a user has violated these Terms, created risk for other users, infringed rights, or used the service in a way that harms SpotActor or the community. You may stop using SpotActor at any time.

9. Disclaimers

SpotActor is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and any warranties arising from course of dealing or usage of trade. We do not guarantee that profiles are accurate, users are verified, opportunities are legitimate, messages will result in work, or the service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, SpotActor and its owners, operators, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, reputational harm, personal interactions, casting decisions, employment outcomes, payments, contracts, or disputes between users, even if we were advised that such damages were possible.

11. Indemnity

You agree to indemnify and hold SpotActor harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from your content, your use of the service, your contact with other users, your violation of these Terms, or your violation of law or third-party rights.

12. Governing law

These Terms are intended to be governed by the laws of India, unless mandatory law in your location requires otherwise. Courts located in India will have jurisdiction over disputes, subject to any consumer protection or mandatory local law that applies.
